As the population continues to age, legal services are necessary to prepare for the inevitable. So that there is no question as to whom is to receive your property, Karla will prepare the necessary will or trust, which will state the beneficiaries. A trust, which may avoid probate and can last a long time, is much more detailed and provides instructions to the trustee as to how the trustee is to manage the assets and income for the economic benefit of the beneficiaries. Whereas, a will disposes the assets immediately after death.
As part of estate documents, Karla may also prepare a living will which tells the doctors and other health care providers what your wishes are while you are alive, a health care directive which tells the health care providers who you want to make decisions for you if you cannot, and a general durable power of attorney to make your financial decisions.
Legal services may also include the preparation of documents to transfer personal property (if the value is less than $75,000) and/or small real estate property (if the value is less than $100,000 less encumbrances). Karla may also prepare and file the appropriate documents for probate, if the estate exceeds the minimum jurisdictional amount as stated above,
